The successful recent appeal for one of our clients marks another successful case where our client secured Convention refugee status after the Refugee Protection Division (RPD) initially refused the claim. Chaudhary Law Office successfully argued that the RPD’s denial was based on flawed credibility findings and a failure to properly assess the risk our client faced.

Key Events:

On March 10, 2023, our client, a citizen of China, sent a critical message mocking the Chinese President on WeChat while outside China, resulting in the 15-day detention of her friend by the Public Security Bureau (PSB) of China.

Later on, March 7, 2025, The RPD division of the Immigration Refugee Board refused our client’s claim, finding her not credible partly due to the alleged lack of corroborating evidence.

Following that, on March 13, 2025, Chaudhary Law Office, represented by Loughlin Adams-Murphy, filed an appeal with the Refugee Appeal Division (RAD). Chaudhary Law Office argued the RPD erred by unreasonably demanding documentation that could not be safely obtained from China’s ubiquitous surveillance state, and by failing to consider the intersectional risk posed by our client’s political opinion combined with her previous employment at the state-run Agricultural Bank of China.

Eventually, on August 7, 2025: The RAD allowed the appeal, set aside the RPD decision, and substituted a determination that our client is a Convention refugee. The RAD confirmed our client faced a serious possibility of persecution. This client is currently awaiting their decision on their permanent resident application.
